Protection for those times when you need a lawyer

Navigating the Canadian regulatory and legal system can be a stressful and time-consuming process. Legal costs can have a considerable impact on your bottom line. To help transfer some of the risk of these unanticipated and potentially large legal expenses, all licensed Nova Scotia Dental Association members are automatically protected by the Legal Protection Plan.

You don’t have to sign up or register, coverage is automatically included with your membership.

What's Covered

With the Legal Protection Plan¹ from ARAG Legal Solutions Inc. (ARAG) and CDSPI you can focus on dentistry with peace of mind knowing you have easy access to legal advice plus coverage for legal representation to support your defense should you be faced with a disciplinary investigation or hearing related to your profession.

A Legal Protection Plan to safeguard your career

As a practicing dentist, you need to think about managing those risks that could leave you financially or professionally vulnerable. The Legal Protection Plan¹  includes the following:

As part of your coverage, your policy provides unlimited access to the ARAG Legal Helpline with no deductible.

A helpline lawyer will provide you with information and assistance on any legal matter, even if it is not listed as a covered event in the policy. For example, although Family Law issues are not covered under this policy, the lawyer will be happy to provide general information on your issue.

  • General assistance for any legal question
  • Unlimited, no cost and confidential access.
  • The Helpline is available from 8:00 am to midnight local time, 7 days a week. In addition, ARAG facilitates access to a lawyer twenty-four hours a day, 7 days a week, in emergency situations. Calls to this service may be recorded.
  • You also have the option to call and schedule a time for a Helpline lawyer to call you back when it is most convenient for you.
  • If your legal issue is covered under the policy, the lawyer will then give your file to the ARAG Claims department who will contact you to discuss how your claim will proceed.
  • The Helpline Lawyers will not read or write documents on your behalf.

Disciplinary Hearings and Investigations Legal Expense Coverage

In the event an allegation is made against you, your coverage provides support for legal expenses when responding to provincial regulatory bodies.

  • Up to $20,000 per claim and $50,000 aggregate each policy year
  • $1,000 deductible per claim

You are eligible for the Legal Protection Plan if you are a dentist licensed to practice in the province of Nova Scotia and a member of the Nova Scotia Dental Association (NSDA).

Coverage is automatically included with your NSDA membership.

Occurrence Limit of Indemnity: $20,000

Aggregate Limit of Indemnity: $50,000

Deductible: $1,000

Disciplinary Investigations & Hearings

What is Covered: The Insurer will pay an insured’s legal costs to the annual maximum listed per occurrence in response to a disciplinary investigation or proceeding brought against the insured person by a regulatory or professional body that issued a license to that insured person provided that the disciplinary hearing or investigation relates to the activities of the insured person carried out:

(a) in their professional capacity; and

(b) while a practicing member of the Nova Scotia Dental Association.

What is not Covered: The first $1,000 in legal costs per claim. This is payable if the dispute cannot be resolved by ARAG and requires an appointed representative. This amount is payable to the appointed representative as soon as they are retained.

Please call the ARAG Legal Helpline as soon as practicable following an insured event, and in no event later than 120 days after the date of occurrence of the insured event.

You will not be reimbursed for any costs you incur before ARAG has accepted your claim, even if ARAG later accepts the claim.

This is not a policy for reimbursement of legal costs you have already incurred. If it is necessary to take legal proceedings a lawyer will be appointed by ARAG on behalf of the insured person in accordance with their standard terms of appointment and will be retained by the insured person.
